An emergency rule is a type of rulemaking action intended to permit an agency to act in a specific set of circumstances. An agency may file an emergency rule when the agency determines that regular rulemaking procedures would: "(a) cause an imminent peril to the public health, safety or welfare;
(b) cause an imminent budget reduction because of budget restraints or federal requirements; or (c) place the agency in violation of federal or state law." (Utah Code Section 63G-3-304)
An emergency rule is effective for 120-days. It goes into effect upon filing with the Division of Administrative Rules or on a later date designated in the rule.
